Adopting a Southern Belle Kitten

Our Persians are priced at $1,800.  To reserve a kitten, a non-refundable deposit of $500 (which is applied toward the total purchase price) must be placed.  We cannot hold a kitten without a deposit.  Once the deposit has been paid via one of the payment methods below, please submit the Kitten Deposit Agreement (below), & you will receive a receipt via email along with a copy of the signed Kitten Deposit agreement form.  

We are happy to schedule a video call prior to accepting a deposit for a kitten!  

Kittens may go to their forever homes when they are 12 weeks old.  We are happy to meet within a 2-3 hour radius of Columbia, TN for pick ups.  We do not ship our kittens.

Kitten Deposit Agreement

Breed: Persian

This Agreement ("Agreement") is entered into between Kali Skar of Southern Belle Cattery ("Seller") and ("Purchaser") on the date set forth below.

DEPOSIT

The Purchaser shall pay a non-refundable deposit of $500.00 per kitten which shall be applied towards the Purchase Price of the kitten.  The balance shall be due and payable upon the release of the Kitten to the Purchaser. 

 

The purpose of the Deposit is to ensure the Purchaser’s intent to purchase the Kitten.  The Deposit is non-refundable, should the Purchaser, for any reason, change his/her mind and decide not to buy a Kitten.  A breach of this Agreement either verbal, written or through neglect or failure to communicate by the Purchaser can jeopardize the chances of placing the Kitten in a new home, as quickly as possible.  To ensure the Purchaser’s commitment to purchase the Kitten, the balance should be paid in full and delivery of the Kitten accepted by the date agreed upon by the Seller and Purchaser.

 

The Deposit shall be refunded to the Purchaser if the Seller fails to make the Kitten available to the Purchaser for reasons including, but not limited to, the Kitten’s mortality.  However, the Seller has the option of offering a replacement Kitten of similar quality, which the Purchaser may accept or decline. 


PURCHASE PRICE

The total price for each kitten is $1,800.00. Once the deposit has been paid and the kitten has been selected, the Seller will send the Purchaser a Contract for review & signature.  This Contract must be signed prior to the release of the Kitten.


SELLER’S RIGHT OF REFUSAL

The Seller reserves the right to refuse to sell the Kitten to the Purchaser at any time prior to the Kitten’s pickup.  The Seller’s decision to cancel the sale shall be motivated solely by the Seller’s determination of the best interests of the Kitten.  In that instance, the Seller shall notify the Purchaser in writing of its decision, the reasons for this decision, and the Seller shall thereupon refund the Purchaser’s deposit, at which time, this Agreement shall be null and void.

 

GOVERNING LAW

This Agreement shall be final and binding upon the Purchaser and Seller and shall be governed by the laws of the State of Tennessee.  Parties shall submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of Tennessee.  In the event of a dispute between the Parties, the prevailing party shall be entitled to his/her attorney’s fees and all costs and expenses associated with the dispute.

Sample Kitten Contract & Health Guarantee

SPAY/NEUTER

The Seller requires both males and females to be spayed/neutered by 7 months of age in order to avoid spraying or heat cycles starting. The Purchaser will be given CFA registration papers once the Kitten is spayed/neutered and proof from a vet has been provided to the Seller.

 

PICK UP

The Kitten will come with a welcome packet that includes a small bag of kibbles that the Kitten is used to eating, a few small toys, a blanket, vet records and a list of some recommended products. The Kitten MUST be picked up in a carrier brought by the Purchaser. The Kitten will not be released without a carrier.

 

HEALTH GUARANTEE

The Seller guarantees that before the Purchaser takes possession of the Kitten, it will be examined by a veterinarian and deemed in good health. The Kitten is guaranteed to be in good health at the time of pick up or delivery. Vaccine history and recommendations will be provided.

 

72-HOUR GUARANTEE

Purchaser is encouraged to take the Kitten to a licensed vet of their choosing (at Buyer’s expense) for a health checkup within 72 hours (3 business days), or this guarantee is void. If the Kitten is found to have a pre-existing and life-threatening problem, the Buyer must notify the Seller at once (within the 72-hour period) with the following information:

1.Name, address and phone number of the licensed veterinarian who examined the Kitten.

2.The diagnosis and all medical records.3.If the Kitten dies in the Purchaser’s care, proof of death is required (autopsy if needed).

The Purchaser should make arrangements to return the Kitten to the Seller (at the Purchaser’s cost) within 48 hours from the date of diagnosis with the requested information. The Seller will then take the Kitten to the veterinarian and if the same life-threatening illness is confirmed or death occurs as a result of a life-threatening illness, the Purchaser is eligible for either a refund of the paid price of the Kitten or a replacement Kitten from the next available litter.

 

If it is found by the Seller’s veterinarian that the Kitten does not have a life-threatening illness, the Purchaser may take the Kitten back and pay all related veterinarian costs. If the Purchaser declines to take the Kitten back, no refund will be given. The Seller does not guarantee against treatable nuisances (such as fungus, yeast, parasites, ear mites, respiratory infections, coccidia, giardia, etc.) which are not life threatening and are treatable. Southern Belle Cattery has taken every precaution to avoid these issues.

 

VACCINATIONS

We encourage vaccinating to protect your kitten from potential health hazards, however, it is agreed by both the Purchaser and the Seller that this Health Guarantee is null and void if the Purchaser has the kitten vaccinated for FELV (Feline Leukemia) or FIP (feline infections peritonitis). Besides endangering the life of your kitten, these vaccines are very stressful to the immune system of a young kitten and are not necessary for the continued health of an indoor-only cat who doesn’t have repeated contact with other cats. FELV, Feline Leukemia, IS a contact disease. Only through contact with an infected cat can this be transmitted. While the Feline Leukemia vaccine is relatively safe, it has a minimum protection rate of only 80%. The FIP vaccine is highly controversial, and it has proven ineffective against most strains of the corona viruses associated with the disease. No one knows much about FIP or how it is transmitted. Speculation is that it is an immune system defect. Kittens do not build a lasting immunity to this virus and the vaccine may actually cause your cat to contract the virus. The tests of FIP are highly unreliable and can only, at best, verify exposure to a virus of this type, not necessarily FIP. The FIP test must be repeated several times, as an exposed cat can shed the virus, but never become ill. Keeping your Kitten away from others and indoors at all times, is your best guarantee for avoiding exposure. If you and/or your veterinarian decide to give either of these vaccines, the Seller shall not be held responsible in any way. The Purchaser agrees and understands that the Seller does not guarantee this Kitten for FIP (feline infections peritonitis). No refund or replacement will be given. Southern Belle Cattery has taken every precaution to avoid this issue but because of the nature of this virus, it cannot be guaranteed.

 

The Purchaser agrees to assume all responsibility for veterinarian expenses once the Kitten leaves the possession of the Seller.

The Purchaser agrees to the following:

•Kitten will never be allowed to roam loose outdoors under any circumstances.

•Kitten will be given a quality diet, clean living atmosphere and fresh water.

•Kitten will be in a loving home, kept up on all vaccines and all medical attention and treatment given as necessary.

•Kitten is being placed as a pet.

•Kitten will never be declawed.

•Kitten will never be sold, leased or surrendered to a shelter, pet store, research laboratory or anything of that nature.

•The Purchaser agrees that this is a lifetime commitment.

•The Purchaser agrees that if they cannot keep the Kitten, it must be returned to the Seller and no refund will be given.

•The Purchaser agrees that if any of these conditions are violated, the Kitten will be unconditionally surrendered to the Seller.
